The state as a night-watchman in relation to freedom of expression of mass media

Abstract

The article deals with relationship between state and freedom of expression of mass media. The author seeks to defend thesis of the state as night-watchman in relation to freedom of expression of mass media, which means minimal state whose legislation does not restrict freedom of expression of mass media, but creating conditions for inviolate exercise of freedom of expression of mass media and simultaneously adjusting conditions for limiting freedom of expression solely in order to protect constitutionally qualified interests.

The author also presents three legal areas within the constitutional order of the Slovak Republic, where testing thesis of the Slovak Republic as a minimal state in relation to freedom of expression of mass media.
