Establishment, legal life and termination of a trust may bring several disputes and issues that the court have to authoritatively deal with in order to ensure functioning or existence of a trust. Previous literature concerning the procedural questions related to the still relatively new institution of a trust is leaving aside to define particular types of non-contentious litigations emerging from the substantial law although the engagement of the court is the most district in these procedures.
The engagement of the court and the persons related to the trust in the civil procedure are analyzed in the article and there are presented particular procedures emerging from the substantial law.
