Abstract

The Article deals with the development of non-pecuniary damages after the recodification of private law with a focus on certain law aspects. This Article is primarily concerned with claims arising from damage to health, particularly claims for pain and social impairment.

Statutory regulation of non-pecuniary damage is compared to the current Constitutional Court decisions.
