The ownership interests of state in business corporations and problems of its actual legal regulation

Abstract

Despite the massive privatization of former state enterprises, which was taking place since the last decade of the 20th century, the state has kept a solid number of ownership interests in business corporations. These corporations regularly interact with other legal entities, but it seems that the professional community doesn't pay much attention to the specifics of the relevant legislation.

However there are crucial issues at stake for such a business corporation, especially the question of validity of its legal acts, the form of decision-making process in its supreme body, or the relationship between the corporation and members of its bodies. The article highlights some of the problematic aspects of the actual legislation and partly proposes how to overcome its shortcomings.
