Abstract

A significant Czech expert in administrative law Jiri Prazak commented, in the study Die prinzipielle Abgrenzung der Competenz der Gerichte und Verwaltungsbehorden, on a number of issues of administrative justice. It is noteworthy that many of his ideas from 1889 resonate with current jurisprudence.This paper pays attention to the typology of administrative and judicial adjudication.

The review of decision in the sphere of sanctioning is particularly problematic due to the over-regulation of administrative punishment. In this context, we evaluated the development of hybrid type of control, which is a quasi-judicial review associated with different forms of dialogue between courts and administrative tribunals.
