According to Czech law there are two ways to claim the damages that arose in connection with a criminal offence. The injured party can either file a civil lawsuit or file a motion for damages, compensation of other than proprietary loss and recovery of property obtained as a result of unjust enrichment in criminal proceedings (so-called collateral proceedings).
The aim of this article is to critically evaluate the legal regulation of collateral proceedings in force, which will be the basis for recodification of criminal procedure.
