Erroneous information to a consumer as a misleading commercial practice - Judgement of the ECJ of 16.4.2015 - C- 388/13 (UPC)

Abstract

With the decision C-388/13 continues the ECJ his consumer-friendly legal practice on contract law, and notes that the communication of erroneous information must be classified as "misleading commercial practice" within the meaning of the Directive 2005/29/EC, even though that information concerned only one single consumer. this paper discusses the two main questions referred for preliminary ruling to the ECJ and to the problem of service change.
