Providing pieces of evidence of a person's privacy

Abstract

This thesis analyzes the issue of performance of two different acts of criminal proceedings in a person's privacy - crime scene investigation and house search, search of other places respectively. It deals with the comparison of common and different features, legal conditions for their performance and in particular proposes solutions to various complicated situations that arise while providing pieces of evidence of a person's privacy.

The work also includes author's experience out of a police practice. The use of stated institutions is analyzed from different points of view, when, in relation to the interpretation of legal provisions, argumentation of judgments and author's practical experience, a limit for use of mentioned institutions has been determined.

Such a limit is characterized by the object and purpose that shall be achieved with the act and by the nature of the operation realized in a person's privacy by authorities participating in the criminal proceedings.
