Agreed Punishment - Missing Regulation of Imposing Criminal Sanctions in the Plea Bargain Proceedings

Abstract

This article discusses the possibilities of imposing sanctions within the Plea Bargain proceedings, which purpose is to achieve more lenient criminal sanction for accused persons who show their willingness to agree on their guilt and the facts of the case with the prosecutor. However, the Czech Law lack explicit regulation of this more lenient approach to such accused persons and it is therefore not entirely clear how exactly the accused persons's declaration on having committed the prosecuted crime as part of the Agreement on Guilt and Punishment should be rewarded.
