Abstract

Chapter analyzes Member States' obligations towards refugee in international law. Then focuses on the obligations of states in the EU law, which explicitly defines another protection status, which is described there.

The subchapter on the national law of the Czech Republic explains the national obligations, which combines all the previous and adds possibility of a status under the territorial asylum. The article pays attention to the definition of a refugee (inclusive, exclusive and cessation clauses) and the obligation of non-refoulement, and also to the meaning of the specific concept in the European Union law - international protection.

It also deals procedural specificities such as safe third country or safe country of origin. The part on national law focuses not only on material law, but also on procedural guarantees.
