Abstract

The chapter addresses the question how to apply the right to a defense in the proceedings of administrative offenses. It asks in particular what is the extent to which the defense has a different status in the proceedings on administrative offenses and how it reflects on the extent of the right to defense.

It concludes that the nature of the right to defense is different, but the characteristics in practice are not that different.
