Manifestations of the principle of material truth in a penal order

Abstract

This paper is concerned with the relation between the penal order and the principle of the material truth. The author deals with some problematic points of such a relation, arising primarily from the current legal regulation of the evidence procedure in criminal proceedings.

He analyzes them and takes a stand on them to participate in discussion about recodification
