Accusatory Principle - the Past and the Future

Abstract

This chapter focuses on the monograph by prof. Antonín Růžek "Accusatory Principle in the Czechoslovak Socialistic Criminal Procedure" published in 1964.

The author describes the content and the importance of this monograph and further addresses two issues. Firstly, it is the notion of "act", and secondly it is the issue of indictment monopoly of the public prosecutor.

In this context, the author also addresses the issue of so-called private indictment and subsidiary indictment, and commemorates prof. Ruzek's opinion on this issue.

The author further introduces the readers to historical reviews of prof. Ruzek's monograph and emphasizes that the issues addressed more than half a century ago remain topical even nowadays.
