The validity and enforceability of judgments is an important issue of criminal proceedings. Serious consequences of these institutes, create a need to deal with them on a theoretical level.
It was already realized by Antonín Růžek in a coherent form implemented in the Czechoslovak legal science already in the 50s' of the last century. This chapter shows that his formulated conclusions are still applicable.
It also deals with certain issues related to the applicability of laws allowing intervention in the irreversibility of decisions and decision obligation as characteristic features of validity.
