The restoration of obligatory co-determination - the return of uncertainty

Abstract

The paper concerns with amendment Nr. 458/2016 Coll. to Business Corporations Act, which has restored the obligatory co-determination in joint-stock companies. At the beginning, the author describes the history of co-determination in Czech law.

The main focus of the article is thereafter dedicated to the description of the amendment, its critical evaluation and to interpretation of several explanatory issues. The brief comparison with German and partially British law is included too.
