The theoretical basis of the binding nature of international courts decisions to national courts

Abstract

In this paper the authors characterize the theoretical basis of the binding nature of international courts decisions to national courts and the analysis of assumptions and grounds of the decisions and finally paper contains the analysis of consequences of binding decisions of European courts of human rights.
