Quasi-penal consequences of a legal obligation breach in administrative law

Abstract

The most typical consequence of a legal obligation breach in administrative law is the creation of liability for an administrative offense. Among quasi-penal consequences, which concerns the violator, include the withdrawal of some authorization, making a qualified disadvantage and/or defamation, as well as imposing remedial measures.

The boundaries between penal and quasi-penal consequences are not sharp. The relationship between them can be examined both in national legislation and in the European context.
