Abstract
The Code of Civil Litigation Procedure and the Administrative Procedure Code set out an explicit provision prohibiting the abuse of rights by virtue of law. The article analytically (referring to the results of the legal research mainly in the Czech Republic) deals with the role of the statutory regulation, as well as with how to apply relevant provisions of law in practice.
