The author analyses the German and Swiss regulation of the inapplicability of illegally collected evidence. The author analyses the consequences of the illegal use of evidence and its importance in criminal proceedings.

In conclusion the author finds, that the evidence gained by an unlawful coercion or by a threat of such a coercion is absolutely ineffective.
