Abstract
The correct identification of a controlling entity is a prerequisite for proper preparation of the report on relations. The assessment of the controlling position in the report on relations is a legal issue.
If the reason of supposed or rather by the shareholder alleged inaccuracy of the report on relations is the controlling entity's determination, should the court assess this fact in the procedure for appointment of an expert or in the further proceedings.
