Sociological Constitutionalism: An Introduction

Abstract

The chapter provides a comprehensive introduction to the emerging field of a sociology of constitutions or sociological constitutionalism, constituting a first systematic, state-of-the-art overview of the field. The chapter discusses the different approaches that currently make up this field, ranging from approaches inspired by the work of Niklas Luhmann to approaches drawing on phenomenology and constructivism.

It further engages in the discussion of main trends of constitutionalism and constitutional change, including the emergence of transnational constitutions.
