Legal Personality of a Slave

Abstract

The aim of this article is to elucidate what does it mean and what creates a "person of a slave". Usually it is considered that the slave is not a person, but a mere thing.

To be a slave, therefore, must mean, not to be a person. The problem is that the slave has been considered by the Roman lawyers themselves not just as a mere thing, but at the same time as a person.

In order to explain how the slave could be both, i.e. a thing and also a person the author explains what it means to be a person and why should be a man considered as a person? As a follow-up the author shows in what sense can be considered legal personality of a slave and thus what does it mean a person of a slave - "persona servilis"
