The issue of the identity of an act

Abstract

The article deals with the criminal-law concept of an act, the principle of preserving the identity of an act in criminal proceedings, and the issue of continued criminal offence. The concept of an act is essential also with respect to continuing torts.

The authors point to the changing views in theoretical and decision-making practice in neighbouring Germany and Austria where the concept of a continuing criminal offence was recently abandoned.
