Existence of a Dispute in Front of the ICJ

Abstract

The International Court of Justice (ICJ) requires a dispute between the parties to exist prior to submission of a complaint by an applicant in order to decide in contentious proceedings based on article 36(2) of its Statute. This article discusses the newly defined term of a dispute as the ICJ added an objective awareness test to it.
