Investment research as inducement under directive MiFID II regime

Abstract

The MiFID II Directive introduces entirely new requirements related to the production and use of so called investment research. These requirements are much stricter in many aspects.

This article focuses on these new requirements. Firstly, the institute of investment analysis or investment research will be introduced, then the current regulation on investment research and its provision in the directive MiFID, regulation MAR and their implementing acts will be analyses.

Next part of this article will deal with the issue of investment research and its definition in MiFID II as well as with the aspects related to the use of investment research by investment firms when providing other investment services. The special attention will be paid to administrative and organisation requirements related to the classification of investment research as an inducement.
