Theoretical background for binding effect of international courts' decisions for national courts

Abstract

Paper deals with conditions under which are decisions of international courts binding for national courts. Paper analyzis effects of decisions of international courts for national legal systems.

The issue is demonstrated on decision making practice of Euroepan Court of Human Rights.
