On the Issue of Foreign Terrorist Fighters

Abstract

The chapter points out the phenomenon of foreign terrorist fighters representing one of the current threats of international terrorism. The increase in the number of foreign terrorist fighters in the most recent period as well as the fact that these persons have been involved in the terrorist attacks in Europe resulted in adoption of the measures aiming at suppression of this phenomenon.

Concurrently, an important role is played by the measures developed for the purpose of detection and disruption of the pathways relating to the terrorist activities and from a criminal law standpoint the requirement for criminalization of travelling for terrorist purposes is crucial. Therefore, the chapter also examines the possibilities to apply a criminal liability of a "traveler for terrorist purposes" pursuant to the current Czech criminal code in comparison to the requirements of the adopted Directive on combating terrorism.
