The issue of sharing economy in the area of transport of persons

Abstract

The aim of this article is to eveluate the domain of the modern phenomenon of collaborative or sharing economy within the frame of transport of persons sector. The author is first of all trying to brifly explain the fundamental terms used in the area of collaborative economy and regularities of its functioning.

Further chapters are dedicated to the comparision of the legal requirements applied in the area of transport of persons provided per taxiservice with requirements applied in the area of transport of persons provided per services interposed through digital platforms. The fundamental passage is dedicated to the position of European commission to the discussed issue and to the relevant european and domestic judgements, in particular with regard to the legal status of service provider and the legal status of digital platform in the role of entrepreneur.

Closing remarks are dealing with the issue of the ways of possible new legal regulation for the future and are raising also the question, whether the special legal regulation for the area of sharing economy is anywise necessary and useful.
