Abstract
The theme of this article is the issue of expropriation for the needs of construction of railway tracks, tram tracks and similar tracks. The main attention is focused on Act No. 266/1994 Coll., in light of its amendment, Act No. 319/2016 Coll.
This article describes the main benefit of the Act No. 319/2016 Coll, specifically the designation of the constructions of the railway tracks and similar tracks with the fundamental traffic significance as publicly beneficial and embedding of opportunities to withdraw or limit the right of ownership to land or to construction or the right corresponding to an easement to the land or to construction for the needs of the construction of the railway tracks and similar tracks.
