When law talks to art - should art be afraid? (Deliberation on the legal protection of artistic freedom based on the case of red boxers floating above the Prague Castle.)

Abstract

The paper deals with the relationship between law and (visual) art. Based on inspiration from autistic's group action called "President's Dirty Laundry" the question how the (Czech) law protects and could protect artistic freedom is discussed.

Together with the legal regulation the relevant case law of the Czech Constitutional Court as well as the European Court of Human Rights is also analysed. The main purpose of the paper lies in the call for further development of the presented topic.
