The Significance of the Threat to Public Policy in the Exercise of Free Movement of EU Citizens

Abstract

Among other things, the author seeks to define public policy in EU law, and examines the states' discretion in defining the national concept of public policy in accordance with their own national needs, as well as any possible restrictions thereof. Also discussed is the possibility for the Court of Justice of the EU to monitor national interpretations.

Furthermore, the author presents a possible future development, arguing for the creation of commonly defined restrictive measures with respect to public policy.
