Actio rerum amotarum

Abstract

Actio rerum amotarum is a specific action of Roman law, used in the cases when one of the spouses had removed a thing from another spouse in order to keep it after the divorce which later occurred. Between the spouses the actions arising from the theft were not possible, and this was the reason for introducing the actio rerum amotarum by praetor's edict.

At first, the chapter deals with the property relationships between spouses and its division in case of ending of the marriage. Later on, the chapter analysis the actio rerum amotarum and its character on the basis of the Roman law sources, Digest of Justinian in particular.
