Abstract

This book deals with the original acquisition of ownership in Roman law and in Civil Codes of Czechoslovakia and the Czech republic. The first part provides basic information about roman ownership in general.

Second part contains development of the means of acquiring the right to property in Roman law and in modern private law codes. Original acquisition occurs when property is acquired otherwise than from a previous owner.

This book is trying to find out relations between old Roman means of acquisition and their appearance in the current legal system. The development of some institutes was not easy, especially because of discontinuous legislation during socialist period of state organization.

Despite that, the current Czech Civil Code is trying to return to old Roman tradition.
