The question of fact and the question of law in procedural law as a prerequisite for invocation (a sketch on an invisible problem)

Abstract

For purposes of the traditional review of decisions of the loweer courts it is important to have some filter as a barrier against the flod of appeals. The supreme courts usually deal only with the so called legal questions and ignore the questions of facts.

The contribution deals with criteria of distinguishing these two questions and in the second part focuses on the foreign law when applicable through the prism of legal question or question of facts.
