Public Administration on Cross-Roads of Administrative Pluralism

Abstract

Traditional administrative relations, limited by the territories of the sovereign States, have been gradually replaced by administrative relations described as "administrative pluralism." In these relations, administrative authorities of the Member States face legal effects of foreign administrative decisions in their own territory. This contribution deals with three different problems arising from this new model of administrative relations: Firstly, which administrative authority will be in charge of executing administrative surveillance vis-á-vis the addressee of the decision? Further, what kinds of powers do the administrative authorities of the host Member State possess in relation to the foreign administrative decision? At last, but not at least, what kind of law is to be applied for qualification of a foreign administrative decision in a case, the administrative authority of the host Member State is empowered to review such an act.
