The possibilites of resolving family disputes

Abstract

The chapter deals with the possibilities of resolving disputes in the context of a new private law in the sense of a natural concept. It explains the basic legal regulation of family relationships in the new Civil Code and mentions the fundamental rights of children under the Convention on the Rights of the Child.

In particular, it focuses on parental responsibility and the possibility of public intervention through the child's social and legal protection bodies. Represents the legal regulation of mediation pursuant to Act No. 202/2012 Coll. and the individual mediation methods by which the mediator can lead mediation.

It explains the role of lawyers in out-of-court dispute resolution and mentions the process of the collaborative law. It emphasizes the need for cooperation between individual institutions providing services to families in order to find the most effective way to resolve family disputes.
