Abstract
The author analyses whether the existing legislation that prohibits the transfer of a business shares in an unlimited partnership is appropriate. On the basis of comparisons with other legal approaches (especially the German-speaking countries) and comparison with the historical regulations which were in force on our territory, he concludes that the transfer of a business shares in an unlimited partnership should be allowed.
In conclusion, the author presents the benefits of allowing the transfer of a business share as well as the proposals de lege ferenda.
