Criminal Law Protection of the Creditor in the Case Law of the Supreme Court of the Czech Republic

Abstract

The contribution deals with the protection of the creditor as one of the parties to the obligation, mainly through the elements of certain so-called "bankruptcy offenses". The author selects certain decisions of the Supreme Court of the Czech Republic which define or specify the general conditions of criminal liability or the elements of the relevant crimes and their relationship.

Criminal liability for certain so-called bankruptcy offenses is also subject to an analysis of the principle of subsidiarity of criminal repression.
