This contribution poses a reflection on the principle of liability based on culpability as one of the most fundamental principles of Czech substantive criminal law. The author criticizes a recent trend of asperating the criminal repression with extensive interpretation of the doctrine of eventual intent.
It analyses its conceptual elements and their expression in relevant case law and pays special attention to the issue of eventual intent regarding the presence of credit card in the purse or wallet of a victim of robbery of theft where the perpetrator's main intent was aimed at the money.
