Right to adequate instruction on rights and obligations in public administration

Abstract

The paper deals with the duty of the administrative authorities to instruct (advice) the concerned persons about their rights and obligations in the area of public administration. The right to adequate instruction (advice) is part of a constitutionally uaranteed right to a fair trial demonstrated in several forms specifically in administrative proceedings commenced by virtue of office for imposing an official duty.

The paper shows common as well as different attributes in the instructions (advice) of the persons involved in judicial proceedings and administrative procedures.
