Abstract
In recent decades, we can observe the increasing demands of the civil proceedings and, therefore, the responsibility of the parties for their process and result. In the contentious proceedings, the procedural party can not expect the positive effect if it is passive.
The active role of the parties to s case, linked to procedural responsibility for the result of the proceedings (the burden of allegation and the burden of proof), is today a generally recognized necessity.
