Judgment of recognition

Abstract

Judgment of recognition may be issued under the current legislation, both in the case of the acknowledgment of a claim in the proceedings by the defendant, and on the basis of the fiction of that acknowledgment of a claim (in accordance with Section 153a (3) in conjunction with Paragraph 114b (5) or Section 114c (6) of the Civil Procedure Code). The substance of the new Civil Procedure Code leaves the non-standard legal regulation of judgments delivered by the fiction of acknowledgment of a claim and provides for a judgment of recognition only if the defendant acknowledges the claim.

However, the plaintiff must demand that judgment.
