Abstract
Public liability and damages compensation is one of the substantial features of judicial control of public administration. Claims for compensation based on public liability and rules on the liability of the state for damages are regulated by Act.
No. 82/98 Coll, in the Czech Republic. This paper aims to analyze this regulation especially in the light of recent jurisdiction of the Czech Constitutional Court and point out some of its bottlenecks in comparison to European standards.
