The right to comment on documents in the view of the principle of concentration in planning permission procedure

Abstract

The right to comment on documents which are basis for decision is one of the most important procedural rights of the parties. A "qualified" type of comments of some parties - objections is established in the planning permission procedure pursuant to Sec. 84 et seq. of Act No. 183/2006 Coll., on town and country planning and building code (Building Act).

However these comments are limited by so called time limit concentration. The aim of the article is to find out roots of this right in constitutional law and analyse the reasons for adoption of the concentration of planning permission procedure and its limits.

The aim of the article is also to draw general conclusion applicable to other administrative procedures in which is the concentration occurred.
