CSD operations under the recent EU law development

Abstract

Entities holding a license for the regulated activities of the central securities depository are important subjects of the functioning financial market, because these entities provide all services related to the registration of dematerialized securities. Because of that are regulated by strict public law regulation.

This paper focuses on the most important aspects of the above-mentioned regulation, contained especially in the Regulation of the European Parliament and Council (EU) No. 909/2014. The concept of a central securities depository and its role for the financial market will be briefly defined in the paper, as well as the matter how these are defined in relevant legislation.

Further, the ruled for obtaining the license of central securities depository and relevant qualification requirements necessary to meet will be analysed, as well as the demands on the performance of activities of a central securities depository according to the Regulation No. 909/2014. The mentioned legislation shall be not only analysed in this paper, but also its weaknesses shall be assessed
