Public access to information regarding salaries in the public sector - a case study of the courts with a free hand

Abstract

This paper represents a case study concerning the access to information on salaries in the public sector, deliberated by the Czech judiciary since 2008. My claim is that the judicial rulings regarding this matter are mostly inconsistent, including the ruling of the Constitutional Court from 17 October 2017 (IV. ÚS 1378/16).

Constitutional Court's decision did limit the public access to this kind of information, but also subjected the public authorities to more convoluted testing of every individual applicant, making the day-to-day operations of the public sector even more intricate. According to this paper, the elaborate attitude of the judicial system doesn't correspond to any existing model of judicial deliberation, indicating that a more substantial development is about to happen in this phase of the industrial society's development.
