Abstract
The chapter deals with legal conditions of forced sale of a flat within the meaning of Section 1184 of Act No. 89/2012 Coll., The Civil Code as well as with proceedings on the court order for the sale of the flat. The author also intends the controversial issue of constitutional compliance of this provision as well as to its insufficient reflection in procedural rules.
