Abstract
The article compares the legal regulation of the origin of property right to the subject of work in the Commercial Code and in the new Civil Code. It analyzes the new legal regulation and arrives at the conclusion that the legislators did not use the oportunity to remove minor imperfections of the legal regulation valid earlier - this new regulatio causes more doubts than the previous.
