On the State of Czech Building Law

Abstract

The paper deals with some malfunctions of Czech public building law. It notes at least the pitfalls of the initial and derived conceptual apparatus of the Building Act, the absence of the core of substantive legal regulation, the lack of clarity of legal regulation, the unduly casuistic basis of diff erentiation of legal regimes of placement and execution of constructions, the insuffi cient sophistication of simplifying and accelerated procedures, the confusional structure of supervisory institutes and the problematic distribution of powers of public administration in the cases of the town and country planning and the building code.
