Abstract

Task of this article is to evaluate electronical evidences usage in the Czech Civil Procedural Law. Main sources of this article are Czech acts, EU regulations, judgements and jurisprudence.

The conclusions above are drafted on the basis of comparison of theoretical and practical conclusions concerning to electronical evidences usage in the Czech Civil Procedural Law. The respective article represents practical treatise about electronical evidences which should be helpful to any party proposing an electronic evidence before a court.

The respective reasons above are based on jurisprudence and court decisions combination. This article evaluates electronical evidences' measure of uncertainty (which is unclear in case of electronical evidences very often) with their probative value because the credibility of electronical evidences might be controversial especially for example in case of person authentication.

The main conclusion of this article is that electronical evidences should be considered more as indirect evidences unless there is any higher level of truthiness verification however, their usage in the Czech Procedural Law is ordinary and there is no reason for groundless refusal.
